1910.146(c)(2)  If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces.  NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.  a) Domtar Paper Company, LLC, C10 Conveyor area, on or about January 25th 2024 the employer failed to identify the C10 conveyor tunnel as a permit required confined space and to inform exposed employees of the existence and location of the danger posed by the permit space.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

1910.146(c)(7)(i):  If the permit space poses no actual or potential atmospheric hazards and if all hazards within the space are eliminated without entry into the space, the permit space may be reclassified as a non-permit confined space for as long as the non-atmospheric hazards remain eliminated.   a) Domtar Paper Company, LLC, C10 Conveyor area, on or about January 25th 2024, the employer failed to reclassify the C10 conveyor tunnel as a non-permit required confined space before contractor employees conducted work operations in areas that exposed them to the atmospheric hazard of Hydrogen Sulfide.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. 1910.147(d)(2) Machine or equipment shutdown. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage.   a.) Domtar Paper Company, LLC; 100 West Center Street Johnsonburg, PA 15845 on or about 1/25/2024 the employer did not shut down the chip steam bin in order to stop the production of steam carrying Hydrogen Sulfide to the C10 conveyor tunnel, exposing employees of a contractor to the hazard.    b.) Domtar Paper Company, LLC; 100 West Center Street Johnsonburg, PA 15845 on or about 1/25/2024, the employer did not include in its safety plan, or otherwise communicate to the contractor engaged to clean wood chips from the C10 conveyor tunnel, the employer's alternative protective measures designed to protect employees from exposure to the conveyor during the cleaning process and the contractor's obligation to ensure its employees' use of those measures.
