29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about September 25, 2023, an employee was exposed to fall hazards of heights greater than 6ft to the ground below, while performing an inspection of the subcontractors work without fall protection. The employee suffered multiple broken ribs, broken scapula, broken orbital bone, and several brain hematomas.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) On or about September 25, 2023, an employee was exposed to fall hazards of heights greater than 6ft to the ground below, while performing an inspection of the subcontractors work without fall protection. The employer had fall protection in their work truck but did not think it was necessary for the job due to only performing an inspection of the subcontractor work. Excel Roofing, Inc. does not train their project managers that they have to wear fall protection while inspecting the residential roof that subcontractors are actively working on.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) On or about September 25, 2023, An Excel Roofing Project Manager was inspecting a residential roof at a height above 6 feet while subcontractors were laying shingles. During the inspection, the employee fell off the roof to the concrete below resulting in 10 broken ribs, broken scapula, broken orbital bone, and several brain hematomas. The injured employee was hospitalized for 2 months. Excel Roofing, Inc. reported the employee hospitalization to OSHA on February 14, 2024, 143 days after the incident occurred.
