29 CFR  1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:   (a)  Yard behind house: On or about February 21, 2024, the employer exposed employees to a stuck-by hazard, in that hardhats were not used while performing overhead tree trimming operations.

29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part was not worn and attached to the boom or basket when working from an aerial lift:  (a)   Yard behind house: On or about February 21, 2024, the employer exposed employees to a fall hazard, in that a personal fall arrest or travel restraint system was not used by an employee working from a bucket elevated approximately 40 feet above the ground while performing tree trimming.  Down To Earth Tree Service was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1910.67(c)(2)(v), which was contained in OSHA inspection number 1654233, citation number 1, item number 1A and was affirmed as a final order on April 12, 2023, with respect to a workplace located at 1029 Honey Ridge Rd, Guyton, GA 31312.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) Yard behind house: On or about February 21, 2024, the employer exposed employees to a stuck-by hazard, in that eye protection was not used by employees on the ground cutting limbs with a chainsaw during tree trimming operations.   Down To Earth Tree Service was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1910.133(a)(1), which was contained in OSHA inspection number 1654233, citation number 1, item number 1B and was affirmed as a final order on April 12, 2023, with respect to a workplace located at 1029 Honey Ridge Rd, Guyton, GA 31312.
