29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  a) Excavation: On or about February 22, 2024, employees were exposed to cave-in hazards while working within an eight (8) foot dep excavation without any form of protective system due to the employer failing to conduct inspections of the excavation by a competent person.  Abatement certification and documentation required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) Front yard: On or about February 22, 2024, employees performing residential sewer line repairs, were exposed to engulfment hazards when working inside of an excavation due to a lack of a sloping, benching, or a cave-in protective system.  Abatement certification and documentation required.
