29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)  At a worksite located at 2 Memorial Drive, Kansas City, MO 64108:   Employees were exposed to health hazards in that they may be harmed by the use of a respirator. This was demonstrated on or about March 27, 2024, and at times prior to when employees were exposed to respiratory hazards when employees were directed to use a tight-fitting elastomeric respirator while dry cutting limestone slabs/blocks and had not been medically evaluated before being permitted to use a respirator.

This was demonstrated on or about March 27, 2024, and at times prior to when employees were exposed to respiratory hazards when employees were directed to use a tight-fitting elastomeric respirator while dry cutting limestone slabs/blocks and had not been fit tested on an annual basis before being permitted to use a respirator.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  At a worksite located at 2 Memorial Drive, Kansas City, MO 64108  Employee were exposed to electrical shock hazards. This was last demonstrated on or about March 27, 2024, when an extension cord was being used by employees to power tools and equipment. The extension cord was plugged into another three-outlet extension cord in series. The use of the cords while plugged into another set of extension cords in series is not in accordance with the listing, labeling, and certification of the extension cords.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:               At a worksite located at 2 Memorial Drive, Kansas City, MO 64108:   Employees were exposed to health hazards in the form of silica. This was demonstrated on or about March 27, 2024, and at times prior to when employees were exposed to respiratory hazards when employees were dry-cutting limestone slabs. Wet methods or dust/vacuum collection systems with high-efficiency particulate air (HEPA) filters were not in use. Employees were exposed to respiratory hazards from the accumulation of silica dust when the vacuums systems or wet methods were not utilized during the course of the project.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  At a worksite located at 2 Memorial Drive, Kansas City, MO 64108:   The employer failed to protect employees from both physical and health hazards associated with the production of stone at the facility including but not limited to the cutting of limestone slabs/blocks through a written hazard assessment. This was most recently demonstrated on or about March 27, 2024, and at times before when employees were exposed to physical and health hazards; including but not limited to, toxic or hazardous substances, vibrations, and occupational noises.
