29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at the job site at 3326 Wittinghill Court, Delaware, Ohio 43015: On or about April 1, 2024, the employer did not initiate and maintain safety and health programs related to the framing work that included work rules, hazard detection, and site safety enforcement. Employees were performing framing work using a pneumatic nail gun without eye protection on the roof of a residential home at heights up to 25 feet without fall protection measures utilized, thereby exposing employees to fall and struck-by hazards.  Yadaicela Construction LLC was previously cited under the name Yadaicela General Construction LLC for a Repeat Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1510289, citation number 1, item number 1 and was affirmed as a final order on March 30, 2021, with respect to a workplace located at 756 North Princeton Avenue, Columbus, Ohio 43222.  Yadaicela Construction LLC was previously cited under the name Yadaicela General Construction, LLC. for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1474506, citation number 1, item number 1, and was affirmed as a final order on June 10, 2020, with respect to a workplace located at 7803 Eastcross Drive, New Albany, Ohio 43054.  Yadaicela Construction LLC was previously cited under the name Yadaicela General Construction, LLC for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1460016, citation 1, item 1, and was affirmed as a final order on June 10, 2020, with respect to a workplace located at 868 Peacock Drive, Sunbury, Ohio 43074.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at the job site at 3326 Wittinghill Court, Delaware, Ohio 43015: On or about April 1, 2024, an employee was operating a pneumatic nail gun while sheathing the roof of the two-story residential home without utilizing eye protection and was thereby exposed to struck-by hazards associated with nails and wood particles.  b. Located at the job site at 3326 Wittinghill Court, Delaware, Ohio 43015: On or about April 1, 2024, employees were operating portable circular saws to cut down wooden materials to size without utilizing eye protection and were thereby exposed to struck-by hazards associated with wood and wooden particles.  Yadaicela Construction LLC was previously cited under the name Yadaicela General Construction LLC for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1618062, citation number 1, item number 1 and was affirmed as a final order on August 23, 2023, with respect to a workplace located at 6015 Peck Lane, New Albany, Ohio 43054.  Yadaicela Construction LLC was previously cited under the name Yadaicela General Construction for a Repeat-Serious violation of this Occupational Safety and Health standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1510289 citation number 1, item number 2, and was affirmed as a final order on March 30, 2021, with respect to a workplace located at 756 North Princeton Avenue, Columbus, Ohio 43222. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. Located at the job site at 3326 Wittinghill Court, Delaware, Ohio 43015: On or about April 1, 2024, the employer failed to protect employees working at heights of up to approximately 25 feet from fall hazards while they sheathed the roof of a two-story residential home.
