29 CFR  1910.37(a)(3):Exit route(s) were not kept free and unobstructed:  a) Workplace, back warehouse, facing west-The designated emergency exit route between shelving rows A and B were obstructed by four pallets of materials, an empty pallet truck and an empty cart; on or about 4/5/24.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  Instance A) Workplace, 7500 New Horizons Blvd., Amityville, NY- Employee stood on the forks of a Raymond Forklift that had a nylon  line tied to the Lift Control Lever to raise himself to shelving 15' high; on or about 4/5/24.  Instance B) Workplace, 7500 New Horizons Blvd., Amityville, NY- An employee was observed standing on the forks of the forklift while using a canvas line tied around the forklift Lift Control Lever to raise himself shelving 15' high; on or about 9/13/24.   Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a) Workplace, 7500 New Horizons Blvd., Amityville, NY- The employer authorized employees to operate forklifts throughout the facility but did not train or ensure that operators had received adequate training and the employer did not evaluate powered industrial operator's performance; on or about 4/5/24.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
