29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Agriculture Reference: 1928.21(a)(5)).   a.  On or about April 19, 2024 and at times prior, throughout the facility, the written hazard communication program was not effective in describing how criteria specified in paragraph (g) of this Section for safety data sheets, and (h) of this Section for training would be met for employees engaged in cannabis growing activities using hazardous chemicals such as, but not limited to carbon dioxide and plant fertilizers.

On or about April 19, 2024 and at times prior, throughout the facility, safety data sheets were not maintained in the workplace or otherwise made accessible for employees engaged in cannabis growing activities using hazardous chemicals such as, but not limited to carbon dioxide and plant fertilizers.
