OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are operating an air press machine with an unprotected foot pedal actuator. a) Grier Abrasive Co., Inc. - On or about December 1, 2023, in the Molding Department, the foot pedal actuator for the pneumatic press machine "A" was not guarded to prevent accidental operation and/or movement, thereby exposing employees to caught in between hazards associated with the cycling of its pneumatic cylinders.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Molding Department- On or about April 24, 2024, the employer did not ensure that all guards on machines, such as air press machine "A", were affixed and/or secured in a manner that would prevent employees from having any part of their body in between moving machine parts during the operation cycle. b) Molding Department- On or about April 19, 2024, the employer did not ensure that all guards on machines, such as air press machine A25-multi, were affixed and/or secured in a manner that would prevent employees from having any part of their body in between moving machine parts during the operation cycle. c) Molding Department- On or about April 19, 2024, the employer did not ensure that all guards on machines, such as air press machine H-multi, were affixed and/or secured in a manner that would prevent employees from having any part of their body in between moving machine parts during the operation cycle. d) Molding Department- On or about April 19, 2024, the employer did not ensure that all guards on machines, such as air press machine A47, were affixed and/or secured in a manner that would prevent employees from having any part of their body in between moving machine parts during the operation cycle. e) Molding Department- On or about April 19, 2024, the employer did not ensure that all guards on machines, such as air press machine A38, were affixed and/or secured in a manner that would prevent employees from having any part of their body in between moving machine parts during the operation cycle.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a) In the Molding Department -On December 1, 2023, an employee was exposed to machine hazards associated with moving parts and pinch-points during the adjustments of the Press "A" Machine which resulted in the amputation to the employees left middle finger. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.
