29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a)  On or about April 24, 2023, the employer did not ensure that employees using pneumatic nail guns were wearing eye protection equipment.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  On or about April 23, 2024, employees conducting roofing work on a new residential property with a 7:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 8 and 1/2 feet off the roof.  The Shark Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1637040, citation number 1, item number 1 and was affirmed as a final order on March 14, 2023, with respect to a workplace located at 819 East Division Street, Watertown, WI.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a ) On or about April 23, 2024, the employer did not ensure the two Werner portable extension ladders used by employees to access the roof of the residential home extended at least three feet above the upper landing, exposing employees to a fall hazard of approximately 8 and 1/2 foot fall to the ground below.  The Shark Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1637040, citation number 1, item number 3 and was affirmed as a final order on March 14, 2023, with respect to a workplace located at 819 East Division Street, Watertown, WI.
