29 CFR  1926.416(a)(1):The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work:   (a) On or about December 2, 2024, at a jobsite located at 727 E. Michigan Ave., South Milwaukee, WI 53172, employees worked on the roof of a detached garage installing a new roof.  During the work an employee lifted the electrical service drop line to the home while another employee conducted new roof installation near the  electrical service line. This exposed employees to an electrical shock hazard.

Michigan Ave. South Milwaukee, WI 53172,  a competent person was on site but did not perform frequent and regular inspections of the jobsite to ensure that hazardous conditions were identified and corrected.  Shark Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2) , which was contained in OSHA inspection number 1743313, citation number 1, item number 1 and was affirmed as a final order on November 5, 2024, with respect to a workplace located at 1129 Lake Park Drive , Pewaukee, WI 53072.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about December 2, 2024, at a jobsite located at  727 E. Michigan Ave. South Milwaukee, WI 53172, employees were operating pneumatic nail guns without eye protection while installing roof shingles. This exposed employees to struck-by and eye impalement hazard.  Shark Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1743313, citation number 1, item number 2, and was affirmed as a final order on November 5, 2024, with respect to a workplace located at 1129 Lake Park Drive, Pewaukee, WI.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about December 2, 2024, at a jobsite located at  727 E. Michigan Ave, South Milwaukee, WI 53172, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the residential structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the roof of the structure of nine (9) feet five (5) inches up to approximately 25.5 feet onto grass, concrete and building materials.  (b) On or about December 2, 2024, at a jobsite located at  727 E. Michigan Ave, South Milwaukee, WI 53172, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the detached garage structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the roof of the structure of eight (8) feet onto grass, concrete and building materials.  Shark Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1743313, citation number 2, item number 1, and was affirmed as a final order on November 5, 2024, with respect to a workplace located at 1129 Lake Park Drive, Pewaukee, Wisconsin.  Shark Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1637040, citation number 1, item number 1 and was affirmed as a final order on March 14, 2023, with respect to a workplace located at 819 East Division Street, Watertown, Wisconsin.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about December 2, 2024, at a jobsite located at  727 E. Michigan Ave. South Milwaukee, WI 53172, the portable ladder being used by employees to access the roof of the main house structure near the front door did not extend at least three feet above the upper point of contact with the eave, nor was it secured in place. This exposed employees accessing and egressing the roof, to a fall hazard of approximately  nine (9) feet five (5) inches onto grass, building materials, and  concrete.  (b) On or about December 2, 2024, at a jobsite located at  727 E. Michigan Ave. South Milwaukee, WI 53172, the portable ladder being used by employees to access the roof of the main house near the back door of the structure, did not extend at least three feet above the upper point of contact with the eave, nor was it secured in place.
