29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse. On or about June 12, 2024, on the northside of the store (back room), employees were working around wooden pallets that were stacked on their sides in the vicinity of the cardboard balers: Instance A: The northeast cardboard baler (#1) had two blue-painted wooden pallets stacked on their side. Instance B: The northwest cardboard baler (#2) had one blue-painted wooden pallet stacked on its side.

29 CFR 1910.303(g)(1)(i): The dimension of the working space in the direction of access to live parts operating at 600 volts or less and likely to require examination, adjustment, servicing, or maintenance while alive was less than indicated in Table S1. On or about June 12, 2024, within the Kroger #359 Store, employees were working in the immediate vicinity of blocked electrical panels: Instance A. In the eastern side of the store, in the produce/bakery hallway, the electric panels were blocked by a blue painted metal cart containing fresh produce. Instance B. In the northern side of the store, adjacent to Baler #1, the electric panel was blocked by a blue painted, 4'x4' wooden pallet. Kroger was previously cited for a violation of the Occupational Safety and Health Standard 29 CFR 1910.303(g)(1), which was contained in OSHA inspection number 1662000, citation number 1, item number 5 and was affirmed as a final order on 10/10/2023 with respect to a workplace located at 9919 Westheimer Rd., Houston, TX 77042. Kroger was previously cited for a violation of the Occupational Safety and Health Standard 29 CFR 1910.303(g)(1), which was contained in OSHA inspection number 1421080, citation number 1, item number 1b and was affirmed as a final order on 01/29/2020 with respect to a workplace located at 1524 Highway 16 West, Spalding, GA 30223.

Kroger was previously cited for a violation of the Occupational Safety and Health Standard 29 CFR 1910.303(g)(1)(ii), which was contained in OSHA inspection number 1613884, citation number 1, item number 1 and was affirmed as a final order on 11/16/2022 with respect to a workplace located at6030 Stetson Hills Blvd, Colorado Spring, CO 80922.
