OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.    On or about July 3, 2024, at 172 - 184 Ave Sheridan Street, Pembroke Pines FL 33029, employees were exposed to high heat from working in direct sunlight while performing landscaping job duties such as grass cutting. The calculated Wet Bulb Globe Temperature (WBGT) between 6:53 am and 3:53 pm ranged from 80 - 88 degrees Fahrenheit with a heat index up to 105 degrees Fahrenheit. Such exposures may lead to the development of serious heat- related illnesses such as, but not limited to, heat cramps, heat exhaustion, heat stroke, and up to and including death. An employee had been working approximately 7 hours cutting grass with a weed eater when the employee was observed exhibiting symptoms of heat exhaustion such as fatigue, weakness, and disorientation. The employee was hospitalized due to the occupational heat exposure.    On or about July 13, 2024, at 17189 Sheridan Street, Pembroke Pines FL 33029, employees were exposed to high heat from working in direct sunlight while performing landscaping job duties such as grass cutting. The calculated Wet Bulb Globe Temperature (WBGT) between 6:53 am and 1:53 pm ranged from 76 - 95 degrees Fahrenheit with a heat index up to 107 degrees Fahrenheit. Such exposures may lead to the development of serious heat- related illnesses such as, but not limited to, heat cramps, heat exhaustion, heat stroke, and up to and including death. An employee had been working approximately 5 hours cutting grass with weed eater when the employee was observed exhibiting symptoms of heat exhaustion such as fatigue, weakness, and disorientation.
