29 CFR 1926.652(a)(1):  Employees in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a)Hunter Homes, LLC at 844 Yorktown Boulevard, Box Elder, SD 57719: On or about and at times prior to July 15, 2024, the employer did not ensure employees installing meter pits within an excavation greater than five feet in depth were protected from cave-in hazards by an adequate protective system.  This condition exposed the employee to a crushing and cave-in hazards.  (b)Hunter Homes, LLC between 848-856 Yorktown Boulevard, Box Elder, SD 57719:  On or about and at times prior to July 16, 2024, the employer did not ensure employees installing sewer pipe within an excavation greater than five feet in depth were protected from cave-in hazards by an adequate protective system.  This condition exposed the employee to a crushing and cave-in hazards.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a)Hunter Homes, LLC at 844 Yorktown Boulevard, Box Elder, SD 57719: On or about and at times prior to July 15, 2024, the employer did not ensure employees installing meter pits within an excavation greater than four feet in depth were provided a safe means of egress.  Employees were provided an extension ladder that was placed against a vertical unprotected trench wall.  This condition exposed the employee to a crushing and cave-in hazards.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:   (a)Hunter Homes, LLC at 844 Yorktown Boulevard, Box Elder, SD  57719: On or about and at times prior to July 15, 2024, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions in that, employees working in an excavation for the installation of meter pits had not received any training on excavation safety.  This condition exposed employees to cave-in and struck-by hazards.
