29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. (a) New entrance awning - On or about July 16, 2024, the employer exposed employees to a fall hazard, in that a harness with a lanyard attached to the boom or basket was not worn by each employee that worked from an aerial lift at a 13' fall to ground distance.

29 CFR 1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. (a) New entrance awning - On or about July 16, 2024, the employer exposed employees to a fall hazard, in that an employee climbed onto and off the mid-rails and top rails of Genie S60 Telescoping Boom Lift to access a steel beam at a 13' fall to ground distance.
