OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to struck by and/or crushed-by hazards: a) Jobsite located at 215 West Erie Avenue, Philadelphia PA - Warehouse - On or about July 24, 2024, the employer did not furnish employment and a place of employment which were free from recognized hazards for employees working within the vicinity of an industrial steel racking system used to store material for food storage and preparation, chemicals, and paper products. The racking system utilized columns that were not anchored to the floor, exposing employees to unstable racking systems.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Jobsite located at 215 West Erie Avenue, Philadelphia PA - On or about July 24, 2024, the employer did not ensure that powered industrial truck (PIT) operator operating stand-up PIT s such as, but not limited to the, Crown RR S700 and Crown SC S200 successfully completed the training and evaluation to ensure operators have the knowledge and skills needed to operate the powered industrial trucks safely, thereby exposing employees to caught in-between hazards. Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.
