29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   Employees are exposed to struck-by hazards at the temporary worksite located at 9047 6th St, Great Bend, KS 67530. Employees engaged in material-handling activities using the Gehl Dynalift telehandler, model number 553, serial number JP023888, were exposed to struck-by hazards in that an evaluation of the operator's performance was not provided prior to permitting forklift operation.

The employer allowed employees to operate a Gehl Dynalift telehandler, model number 553, Serial Number JP023888,  without evaluating their employee performance or competency and without certification that employees were trained to operate the telehandler.

29 CFR  1926.416(a)(1): The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work:   On or about August 13, 2024, at the temporary worksite located at 9047 6th St, Great Bend, KS 67530  employees worked near an energized powerline and were exposed to electrical shock while operating the Genie Aerial Lift model Z-80/60 with serial number Z8011-2924. The arm of the aerial lift contacted the overhead power line. An employee grabbed the power line when trying to move the line sleeve and was electrocuted.

29 CFR 1926.416(a)(3): The employer began work without determining if employees could contact any part of an energized circuit and did not post warning signs and advise employees of the location of the circuit, hazards, and protective measures they need to take.  On or about August 13, 2024, at the temporary worksite located at 9047 6th St, Great Bend, KS 67530 employees worked near an energized powerline while operating the Genie Aerial Lift, model Z-80/60 with serial number Z8011-2924; employees in the lift basket were exposed to electrical shock. One employee was electrocuted and a second received electrical burns and was hospitalized. The employer did not post warning signs, provide protective measures, or communicate hazardous locations to employees.

29 CFR 1926.453(b)(2)(ii): Unauthorized persons were operating an aerial lift.  On or about August 13, 2024, at the temporary worksite located at 9047 6th St, Great Bend, KS 67530, an employee was exposed to struck-by, fall, and electrical shock hazards when operating a Genie Aerial Lift, model Z-80/60 with serial number Z8011-2924 without training. An unauthorized employee was operating the lift without adequate training before use. The employee was not informed of the location of energized overhead electrical hazards, did not have experience operating the lift, and used no body belt with a lanyard or personal fall arrest when in the lift basket. The employee contacted the overhead powerline with his hand and was electrocuted.

At the temporary worksite located at 9047 6th St, Great Bend, KS 67530, employees were exposed to fall hazards. Employees working from the Genie Aerial Lift Model Z-80/60 and Serial Number Z8011-2924, did not use a body belt with a lanyard attached to the basket. The basket was elevated more than ten feet above the ground.
