29 CFR  1903.19(d)(1):The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1, item 1, group letter b, for hazards associated with the lack of a fall protection training program.

29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.    On or about September 11, 2024, during a TPO installation on the balcony roofs at an apartment complex located at 1957 CARTER ROAD, CLEVELAND, OH 44113, the employer did not ensure employee(s) working from low-sloped balcony roofs were protected from a fall of approximately 11.4 feet by the use of a guardrail system, safety net system, personal fall arrest system and/or combination warning line system and safety monitoring system.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about September 11, 2024, during a construction project at an apartment complex located at 1957 CARTER ROAD, CLEVELAND, OH 44113, the employer did not ensure that employee(s) installing a TPO membrane on the balcony roofs were provided training on how to recognize the hazards of falling and procedures to minimize those hazards.
