29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  On or about October 15, 2024, employees engaged in material handling activities at the facility located at 1605 West I Street, Hastings, Nebraska were exposed to struck-by hazards in that the Yale, Lift Truck Model GLP050TG, Serial Number A875B24296A was being operated with an elastic chord wrapped around the brake pedal because the internal return spring had been removed.

29 CFR  1910.178(a)(6): The employer did not ensure that all nameplates and markings were in place:   On or about October 15, 2024, employees engaged in material handling activities at the facility located at 1605 West I Street, Hastings, Nebraska were exposed to struck-by hazards in that the employer failed to ensure the Yale, Lift Truck Model GLP050TG, Serial Number A875B24296A had a data plate with the equipment lifting/operating limitations affixed to the fork truck.

29 CFR  1910.178(q)(7): Industrial trucks were being placed in services after the examination showed condition(s) adversely affecting the safety of the vehicle:   On or about October 15, 2024, employees engaged in material handling activities at the facility located at 1605 West I Street, Hastings, Nebraska were exposed to struck-by hazards in that the employer failed to ensure the  Yale, Lift Truck Model GLP050TG, Serial Number A875B24296A was examined prior to use.  Examples of conditions that adversely affect the safe operation of the vehicle include but are not limited to:  a)  The fork truck missing a data plate with lifting/operating limitations. b)  The fork truck having a bungy cord used in lieu of the manufacturer installed brake return spring.

29 CFR  1910.212(a)(1):  One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about October 15, 2024, employees who operate the Ellis Mitre Band Saw at the L-H Manufacturing facility located at 1605 West I Street, Hastings, Nebraska were exposed to hazardous operation conditions that may result in lacerations and amputations because the exposed unused portion of the horizontal band saw blade was not guarded to protect against unintentional or incidental contact. The exposed part of the unused blade was measured at 13.5 inches.
