29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about November 19, 2024, in the north end of the highway construction work zone area; subcontracted dump truck drivers operated dump trucks without any instructions about site work zone hazards or controlling employer procedures, processes, or safety requirements.

29 CFR  1926.601(b)(4):The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle.  On or about November 19, 2024, in the dump truck lane of the work zone on the north end of the highway construction area; employee(s) stood at a tailgate of a company pickup truck parked behind a dump truck with an obstructed view to the rear that did not have a working reverse signal alarm or a spotter.
