29 CFR 1910.147(c)(2)(ii): The employer's tagout energy control program procedures did not successfully comply with 29 CFR 1910.147(c)(3) and no lockout was provided for employee protection:  On or about November 25, 2024, Alta Mira Corporation DBA Spencer Forge and Manufacturing Company at 225 N. Main Street Spencer, OH 44275, did not ensure that a lockout was utilized instead of a tagout when the Mori Seiki Co., Ltd. CNC Metal Chip Conveyor connected to the Mori Seiki Co., Ltd. Lathe Machine (Model #SL25B, Serial #2204, Identifier #550) was taken out of service. The Conveyor was capable of being locked out and the tagout utilized did not provide full employee protection, as the power cord to the Conveyor was not locked out allowing it to be plugged back into the Lathe Machine.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  On or about November 25, 2024, Alta Mira Corporation DBA Spencer Forge and Manufacturing Company at 225 N. Main Street Spencer, OH 44275, did not ensure periodic inspections of energy control procedures were conducted at least annually, including a review of each authorized employee's responsibilities under the energy control procedures. Authorized employees are required to conduct service/maintenance activities on the Mori Seiki CNC Lathe machines (Model #'s SL25B (Identifier #550 &#551), SL35B (Identifier #565), SL303B (Identifier #554) within Plant 1 & 2, requiring them to perform lockout/tagout.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a. On or about November 25, 2024, Alta Mira Corporation DBA Spencer Forge and Manufacturing Company at 225 N. Main Street Spencer, OH 44275, did not ensure the operator(s) of the Mori Seiki Co., Ltd. Lathe Machine (Model #SL25B, Serial #2204, Identifier #550) located within Plant 2, were protected by one or more methods of machine guarding from the hazards created by the point of operation and rotating parts of the machine. The doors to the Mori Seiki Co., Ltd. Lathe Machine were not equipped with interlock devices or other methods of machine guarding which allowed the machine to operate with the doors open.  b. On or about December 12, 2024, Alta Mira Corporation DBA Spencer Forge and Manufacturing Company at 225 N. Main Street Spencer, OH 44275, did not ensure operator(s) of both Marvel PA13-3EPC Production Bandsaws (Identifiers #102A & 102B) located within Plant 1, were protected by one or more methods of machine guarding from amputation hazards created by the point of operation of the machines.

On or about November 25, 2024, Alta Mira Corporation DBA Spencer Forge and Manufacturing Company at 225 N. Main Street Spencer, OH 44275, did not ensure that the Oxygen Compressed cylinders located within the Maintenance Shop were being stored away from highly combustible material likely to cause or accelerate a fire. The Oxygen Compressed cylinders were being stored with Acetylene fuel-gas cylinders.
