29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) On or about December 18, 2024, at the jobsite located at N93W23781 Pebble Brooke Way, Libson WI, an employee was operating an JLG all-terrain forklift to lower two subcontractors, tools, and materials without receiving training nor an evaluation to operate an all-terrain forklift.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about December 18, 2024, at a jobsite located at N93W23781 Pebble Brook Way, Lisbon, WI 53089, an employee was operating a pneumatic nail gun without eye protection while framing inside a residential home. This exposed the employee to a struck by hazard and eye impalement injuries.  FMM Builders LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.102(a)(1), which was contained in OSHA inspection number 1739838, citation number 1, item number 1 and was affirmed as a final order on May 20, 2024, with respect to a workplace located at W23N9484 Pebble Brook Way, Lisbon, WI 53089.

(a) On or about December 18, 2024, at a jobsite located at N93W23781 Pebble Brook Way, Lisbon, WI 53089, the employer did not ensure that an employee working from a JLG all-terrain forklift at an approximate height of 11 7/10 feet was protected from falling to the lower level.  FMM Builders LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.451(g)(1), which was contained in OSHA inspection number 1739838, citation number 1, item number 2 and was affirmed as a final order on May 20, 2024, with respect to a workplace located at W23N9484 Pebble Brook Way, Lisbon, WI 53089.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)    On or about December 18, 2024, at a jobsite located at N93W23781 Pebble Brook Way, Lisbon, WI 53089, an employee was performing framing work on a single story new construction residential home with a pitch of approximately 8:12 and up to an approximately 11 7/10 fall hazard, without fall protection in place, thereby exposing the employee to a fall hazard.  FMM Builders LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1726279, citation number 1, item number 1 and was affirmed as a final order on July 16, 2024, with respect to a workplace located at 769 Brockway Drive, Mukwonago, WI 53149.
