OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush hazards:  Zhen Hao Trading Inc. 72-2 51st Ave. Woodside, NY.  a) A warehouse employee was exposed to struck-by and crushing hazards while operating a Hyster 4C powered industrial truck without wearing a seat belt or restraint to ensure they remain safely inside the operator's compartment in the event of sudden unexpected motion.; on or about 12/20/2024.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling:    Zhen Hao Trading Inc.  72-2 51st Ave. Woodside, NY.  a) Warehouse employees were exposed to fall hazards while working from the deck of shelving units with unprotected sides approximately 8 feet above the ground.  The employer did not implement fall protection methods including personal protective equipment or guardrail systems; on or about 12/20/2024.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.10.
