29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)Reynolds Construction, LLC at 45240 146th Street, Summit, SD 57266: On or about and at times prior to December 19, 2024, the exposing employer did not ensure employees working in an excavation deeper than five feet were protected from struck-by and cave-in hazards in that no end protection was utilized in conjunction with the Pro-Tec Trench Shield when employees performed work at the open end of the trench shield. This condition exposed employees to struck-by and cave-in hazards.

29 CFR  1926.652(g)(1)(ii):Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads:  (a)Reynolds Construction, LLC at 45240 146th Street, Summit, SD 57266: On or about and at times prior to December 19, 2024, the exposing employer did not ensure employees working in an excavation deeper than five feet were protected from struck-by and cave-in hazards in that the Pro-Tec Trench Shield was not installed in a manner to restrict lateral movement in the event of sudden lateral loads, e.g. cave-in of the trench side wall. This condition exposed employees to struck-by and cave-in hazards.
