29 CFR  1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   a)  At 9913 Foley Beach Express, Retail Shops, Foley, Alabama:  On January 28, 2025; the employer allowed his employees to work from aerial lifts baskets without fall protection while prepping walls for stucco installation exposing his employees to a fall hazard of up to 23 feet to the ground below.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a)  At 9913 Foley Beach Express, Retail Shops, Foley, Alabama:  On January 28, 2025; the employer allowed his employees to work from aerial lifts baskets without first ensuring his employees were trained on the hazards associated with mobile scaffolds such as but not limited to the requirement to use fall protection  exposing his employees to a fall hazard of up to 23 feet to the ground below.
