29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:   29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  a)  On or about March 5, 2025, the employer did not certify that the forklift operator had been trained and evaluated within the past three years as required by paragraph (l) with certification records.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.451(c)(2)(v):Fork-lifts shall not be used to support scaffold platforms unless the entire platform was not attached to the fork while the platform is occupied.  a)  On or about March 4, 2025, employees were exposed to fall hazards of approximately 16.2 while working from a platform elevated by a Caterpillar Model TL943 all-terrain forklift which was not attached to the forks.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
