29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   Facility-wide:  On or about March 6, 2025, the employer did not develop, implement, or maintain a written hazard communication program at the workplace that included labeling and other forms of warning (f), safety data sheets (g), and training (h) for employees exposed to hazardous chemicals used while cleaning countertops, toilets, mirrors, and floors in all rooms of the facility. This occurred while the employees disinfected surfaces using a corrosive hydrogen peroxide-based cleaner called 12% Hydrogen Peroxide (Product Code: HP12-128) with equipment that included, among others, an RT15 Industrial Commercial Use Walk-behind Floor Scrubbers and Bissell Multi-Surface Brush Wet Dry Vacuums.

29 CFR  1910.1200(f)(9):  The employer removed or defaced existing labels on incoming containers of hazardous chemicals and did not immediately mark the containers with the required information   Custodial Service, Room 122:  On or about March 6, 2025, the employer did not ensure that all of the labels on incoming containers of hazardous chemicals were not removed or defaced when containers with labels that were either destroyed or completely defaced were filled with a category 4 corrosive chemical, 12% Hydrogen Peroxide (Product Code: HP12-128), and were not immediately marked with workplace labeling containing the required information. The containers were used by maintenance staff to clean countertops, toilets, mirrors, and floors throughout the facility.

29 CFR  1910.1200(g)(8):  The employer did not ensure that Safety Data Sheets were readily accessible during each work shift to employees when they were in their work area(s):  Facility-wide:  On or about March 6, 2025, the employer did not ensure that Safety Data Sheets (SDS) were readily accessible to employees during each work shift when they were in their work area. Employees were not provided with the SDS for several cleaning products used by maintenance staff, which contained hazardous chemicals that are corrosive to the skin (Category 4) and damaging to the eyes (Category 1). These products included, but were not limited to, a surface cleaner containing a hydrogen peroxide and water mix called 12% Hydrogen Peroxide (Product Code: HP12-128) and FaciliPro Daily Disinfectant Cleaner (Ecolab 6102303), which contained a mixture of ammonium chloride.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Facility-wide:  On or about March 6, 2025, employees were not provided with effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area. After replacing the previous cleaning solution with a new hydrogen peroxide-based solution (12% Hydrogen Peroxide), the employer did not inform employees of the health hazards associated with this new chemical, which was corrosive to the skin (Category 4) and damaging to the eyes (Category 1).
