29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): a) Line 3 Shear Machine at 25 Gage St - On and prior to March 5, 2025, employees were exposed to struck-by and caught-in hazards from the shear knife when operating the Line 3 Shear Machine (Model: SH6014, Serial 121824, Date: AUG 2022) with the guard propped up by materials including a pole which allowed employees to be able to reach the shear knife from the front side of the shear machine with their fingers. b) Line 5 Shear Machine at 132 Flatbush Ave - On and prior to March 5, 2025, employees were exposed to struck-by and caught-in hazards from the shear knife when operating the Line 5 Shear Machine (Model: SH-6014, Serial: 121889, Date: APR 2023) with the guard propped up by materials including conduit and a piece of wood which allowed employees to be able to reach the shear knife from the front side of the shear machine with their fingers.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: a) Worksite - On or about March 5, 2025, an employee operating the Line 5 Shear Machine (Model: SH-6014, Serial: 121889, Date: APR 2023) was hospitalized after the shear knife came down on his fingers. The in-patient hospitalization was reported to OSHA by the employer on March 15, 2025.
