On or about April 24, 2025, employees engaged residential foundation operations located at 3645 South 219th Street, Elkhorn, Nebraska 68022, were exposed to fall hazards in that multiple employees were observed walking onto to and working on the top of the foundation wall at heights greater than 8 feet 8 inches without any form of fall protection.

29 CFR 1926.451(b)(2):Scaffold platforms and walkways were not at least 18 inches wide: On or about April 24, 2025, employees engaged residential foundation operations located at 3645 South 219th Street, Elkhorn, Nebraska 68022, were exposed to fall hazards in that the employer had multiple employees using scaffold planking that was less than 18 inches wide. Employees were observed walking on and working from single wooden planks of varying sizes between 2x4 and 2x12 that were hung using "J" hooks attached to the foundation wall.

29 CFR 1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. On or about April 24, 2025, employees engaged residential foundation operations located at 3645 South 219th Street, Elkhorn, Nebraska 68022, were exposed to fall hazards in that the employer has employees walking on to and working from top of the foundation wall and the scaffold planking system without a safe means of access and egress. Employees were observed crossing the gap between the excavation wall and the foundation wall by stepping onto the top of the foundation wall before stepping down approximately 12 inches onto the carpenter's bracket scaffold. No ladders or stairway access was observed or documented in use.

29 CFR 1926.503(c):The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: On or about April 24, 2025, employees engaged in residential foundation activities located at 3645 South 219th Street, Elkhorn, Nebraska 68022, were exposed to serious injuries due to their inadequate understanding and/or recognition of the fall hazards found at the site and the methods to mitigate those risks. The employer had multiple employees who failed to demonstrate an understanding of the fall protection requirements and fall hazard recognition skills to safely perform work on top of foundation walls. Employees were working at heights greater than 8 feet, 8 inches necessitating effective training.
