29 CFR 1926.503(a)(2): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:   29 CFR 1926.503(a)(2)(ii): The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used.  a) Blue Raven Solar, LLC, at a jobsite located at 5953 Course Drive, Westerville, OH 43081: On or about, and at times prior to April 30, 2025, the employer did not ensure that employees were trained on the correct procedures for erecting a fall protection/prevention system while engaged in residential construction activities. Employees were installing solar panels without ensuring that a compliant fall protection/prevention system was installed in that the employees installed anchor points with the flat end facing up, anchor point lag bolts were installed without embedment in the truss or embedded three inches, and no pilot holes were pre-drilled for the anchor point lag bolts. Additionally, employees did not select and install the correct lanyard for use on a roof with a pitch greater than 4:12 to limit slack in the system and reduce the potential for shock load to the anchor and/or user. This condition exposed employees to fall hazards between 11 and 17 feet.

29 CFR  1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection.   a) Blue Raven Solar, LLC, at a jobsite located at 5953 Course Drive, Westerville, OH 43081: On or about, and at times prior to April 30, 2025, employees installing solar panels on the roof of an existing residential home were not provided with a fall protection/prevention system that was capable of protecting employees from fall hazards between 11 and 17 feet on a roof with a 12:12 pitch.  Blue Raven Solar, LLC  was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 126.502 (a)(2),which was contained in OSHA inspection number 1725979, citation number 1, item number 1. This citation as amended pursuant to the settlement agreement as violation of  OSH ACT of 1970 Section (5)(a)(1) and was affirmed as final order on July 9, 2024, with respect to a workplace located at 2013 Liberty Ln., Gurnee, IL 60031.
