29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a)  On or about May 16, 2025, employees were exposed to eye injuries resulting from utilizing pneumatic nailers while performing framing operations without the benefit of eye protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about May 16, 2025, and at times prior to that date, employees were exposed to injuries from falls in excess of six feet, while walking top plates to set roof trusses, without the benefit of fall protection systems being in place.  Rostro Construction LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1794885, Citation Number 1, Item Number 1, and was affirmed as a final order on January 30, 2025, with respect to a workplace located at 8303 William Downing Dr., Colorado Springs, CO.  Rostro Construction LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1573843, Citation Number 1, Item Number 1, and was affirmed as a final order on March 2, 2022, with respect to a workplace located at 10286 Luneth Dr., Colorado Springs, CO.  Rostro Construction LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1588739, Citation Number 1, Item Number 1, and was affirmed as a final order on May 24, 2022, with respect to a workplace located at 15637 Native Willow Dr., Monument, CO.  Rostro Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1595893, citation number 1, item number 1 and was affirmed as a final order on July 14, 2022, with respect to a workplace located at 15595 Native Willow Dr., Monument, CO 80132.
