29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Juan Garcia at 2410 Sunrise Ridge Circle, Brookings, SD 57006:  On or about and at times prior to June 10, 2025, the employer did not ensure that frequent and regular inspections were conducted by a competent person. This condition exposed employees to various hazards such as fall hazards and a lack of training.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   (a)Juan Garcia at 2410 Sunrise Ridge Circle, Brookings, SD 57006:  On or about and at times prior to June 10, 2025, the employer did not ensure that employees were protected from fall hazards, in that employees were conducting roofing operations on a 4:12 pitch, multi-level residential property without the use of a fall protection system. This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a)Juan Garcia at 2410 Sunrise Ridge Circle, Brookings, SD 57006:  On or about and at times prior to June 10, 2025, the employer did not ensure that fall protection training was documented by a written certification prior to employees being exposed to fall hazards. This condition exposed employees to fall hazards greater than six feet.
