29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  On or about June 12, 2025, and at times prior thereto, in the paint and sandblasting areas, employees were exposed to pulmonary and/or respiratory distress when required to wear abrasive blasting hoods and/or half-face respirators in that the employer did not ensure employees underwent medical evaluations prior to initial use.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  On or about May 22, 2025, and at times prior thereto, in the paint and sandblasting areas, employees required to wear half-face respirators while conducting painting and pot tending operations were exposed to respiratory hazards in that the employer did not ensure employees were fit tested prior to initial use.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about June 12, 2025, and at times prior thereto, employees engaged in sandblasting and painting activities were exposed to hazardous chemicals, such as, but not limited to, 65 Reducer, lacquer thinner, MACROPOXY, and Black Diamond abrasive products.  The employer had not developed a program which would address labeling and other forms of warning on chemical containers, Material Safety Data Sheets, and employee information and training on the hazards associated with chemicals utilized at this site.
