OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  a) Henson Square, Lawrenceville, GA: On July 9, 2025, employees were exposed to high heat from working in direct sunlight while performing landscaping job duties such as laying sod and straw, digging, and light lifting for up to 6 hours. Climatological data indicated a calculated Wet Bulb Globe Temperature (WBGT) ranging from 77°F (25°C) to 89.6°F (32°C) with corresponding heat index values between 83°F (31°) to 99°F (37°C). The employees were engaged in moderate manual labor while wearing long sleeves and long pants. Such prolonged exposure to these conditions significantly increases the risk of serious heat-related illnesses, including heat cramps, heat stress, heat exhaustion, and heat stroke.  b) Alcovy Creek Lot 144, Lawrenceville, GA: On July 9, 2025, employees were exposed to high heat from working in direct sunlight while performing landscaping job duties such as laying sod, digging, and light lifting for up to 50 minutes. Climatological data indicated a calculated WBGT ranging from 86°F (30°C) to 87°F (31°C) between 3:56 p.m. and 4:56 p.m., with a corresponding heat index value of approximately 97°F (36°C) ). The employees were engaged in moderate manual labor while wearing long sleeves and long pants. Such prolonged exposure to these conditions significantly increases the risk of serious heat-related illnesses, including heat cramps, heat stress, heat exhaustion, and heat stroke. An employee experienced a heat stroke while performing landscaping operations. The employee later died at the hospital as a result of exposure to heat.
