29 CFR 1910.23(c)(8): The employer did not ensure that the cap (if equipped) and top step of a stepladder that are not used as steps:  (a)Guerra Framing, LLC at 801 Quince Street, Mitchell, SD 57301: On or about and at times prior to July 21, 2025, the employer did not ensure that the green Keller 6-foot Fiberglass A-frame step ladder the employees were using to perform roof truss installation and wall framing operations on a prefabricated wood structure was installed and used correctly in that employees were permitted to stand on the cap or top step of the stepladder. This condition exposed employees to fall hazards.

29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  (a)Guerra Framing, LLC at 801 Quince Street, Mitchell, SD 57301: On or about and at times prior to July 21, 2025, the employer did not ensure that employees were protected from falls while conducting framing and roof truss installation operations on a prefabricated wood building. This condition exposed the employees to fall hazards greater than four feet.

And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017:  (a)Guerra Framing, LLC at 801 Quince Street, Mitchell, SD 57301: On or about and at times prior to July 21, 2025, the employer did not ensure that employees were properly trained on the use of fall protection systems prior to being exposed to the fall hazards while working on a prefabricated wood building roof.  This condition exposed employees to fall hazards greater than four feet.

29 CFR  1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)Guerra Framing, LLC at 801 Quince Street, Mitchell, SD 57301: On or about and at times prior to July 21, 2025, the employer did not ensure that each employee that was installing roof trusses on a prefabricated wood building with the use of a pneumatic nail gun were protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.
