OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees such as unsafe racking systems:  (a) 2025 Valley Road, Morgantown PA; outside, Shingle Storage Rack - On or about July 22, 2025, the 3-tiered racking system was not labeled with the load limit or anchored to the ground which exposed employees to struck by and crush hazards.  (b) 2025 Valley Road, Morgantown PA; New Shop - On or about August 14, 2025, the grey and orange 5-tiered racking systems were not anchored to the floor which exposed employees to struck by and crush hazards.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
