29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:  Jobsite: Charcoal Grill (Lot #1) located at 133-40 79th Street, Howard Beach, NY.  a) Employees engaged in interior construction activities worked from plywood work platforms approximately twelve (12) feet high supported by a metal grid/framing located approximately 1 foot above a drop ceiling grid system and mobile frame scaffolds work platforms at approximately seven (7) feet high exposing them to fall hazards.  The scaffolding systems were erected by untrained employees without the supervision and direction of a competent person; on or about 07/18/2025.    Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall.  Jobsite: Charcoal Grill (Lot #1) located at 133-40 79th Street, Howard Beach, NY.  a) The employees carried bulky bundles of insulation containing 4 panels that weighed approximately 55 pounds, and each panel measured 2 feet by four feet by 15.26 inches thick (25kg, 0.288 m3 as per shipping label) while climbing A-frame ladders exposing them to fall hazards; on or about July 18, 2025.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19
