OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties:   On or about, and at times prior to, July 30, 2025, employees were exposed to the hazard of high heat from working outside in the direct sun.  Employees were engaged in moderate to heavy workload while doing construction outside with only one break during the day.   On July 29, 2025 while  heat advisory was in effect, an employee was taken to the hospital by first responders, the employee had experiences heat stress to include the inability to walk or stand from heat cramps.  The employee had been working for Mendoza Contracting for approximately two weeks at the time of the incident.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   On or about July 30, 2025 at 43 Captain Bannon Circle, Merrimack, NH.  Employees were exposed to fall hazards of 6 feet or more.  Instances: 1)  A hole in the floor on the first level was unguarded and measured approximately 11 feet 4 inches by 3 feet 4.75 inches and exposed employees to a 8 feet 10 inch fall to the level below.  2) An opening for double doors at the rear of the home.  The opening size as indicated on the architectural drawings was 96" by 80" and he distance from the bottom of the opening to the ground was approximately 10 feet 2 inches.

29 CFR  1926.602(c)(1)(vi):All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  On or about July 30, 2025 at 43 Captain Bannon Circle, Merrimack, NH.   The JLG Lull did not meet the applicable requirements as defined in American National Standards Institute B56.1-1969, Standards for Power Industrial Trucks.  Instances: A) Lull was left unattended with key in ignition. B) Telescopic boom extended and raised while underload. C) Lull operators were not trained on the operations of the Lull.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On our about July 30 , 2025 at 43 Captain Bannon Circle, Merrimack, NH.  The portable ladder used to access the second floor was not extended three feet above the landing.
