OSH Act of 1970 Section 5(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazards associated with working near the bucket of an excavator while in operation: a) On or about August 6, 2025, at a construction site located at 7 Morgan Circle, Stuart, Florida, an employee was exposed to a struck-by hazard when attempting to attach a nylon sling strap to a shackle on the bucket of an excavator in order to raise previously installed fiberglass reinforced panels to a higher elevation. b) On or about August 7, 2025, at a construction site located at 7 Morgan Circle, Stuart, Florida, an employee was exposed to a struck-by hazard when attempting to attach a nylon sling to a shackle on the bucket of an excavator in order to raise previously installed fiberglass reinforced panels to a higher elevation.

29 CFR 1926.251(a)(6): Each day before being used, and during use, where service conditions warrant, the sling and all fastenings and attachments were not inspected for damage or defects by a competent person, and damaged or defective slings were not immediately removed from service: a) On or about August 6, 2025, at a construction site located at 7 Morgan Circle, Stuart, Florida, employees were exposed to a struck-by hazard due to the employer not removing a damaged nylon sling from service. b) On or about August 7, 2025, at a construction site located at 7 Morgan Circle, Stuart, Florida, employees were exposed to a struck-by hazard due to the employer not inspecting a damaged nylon strap and/or removing it from service.
