29 CFR  1910.134(f)(1): The employer shall ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph: [Construction Reference 29 CFR 1926.103]  On August 27, 2025, at a worksite located at 183 Main Street in Fond du Lac, Wisconsin; the employer did not ensure that an employee using tight-fitting facepiece respirators, during the removal of asbestos containing floor tiles, had passed an approved QLFT or QNFT.

29 CFR  1910.134(g)(1)(i)(A): The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function: [Construction Reference 29 CFR 1926.103]  On August 27, 2025, at a worksite located at 183 Main Street in Fond du Lac, Wisconsin; the employer permitted employees wearing tight-fitting negative pressure half-face respirators to have facial hair that came between the sealing surface of the facepieces of their respirators during the removal of asbestos containing floor tiles.

29 CFR  1926.1051(a)(4): When a building or structure has two or more points of access between levels, at least one point of access shall be kept clear to permit free passage of employees:  On August 27, 2025, at a worksite located at 183 Main Street in Fond du Lac, Wisconsin; the employer did not ensure that at least one point of access from the second story to the ground floor was kept clear to permit free passage of employees. The building's rear upstairs exit to the lower level was blocked by waste materials. The front passage was a stairwell which was not kept clear of stored materials, such as but not limited to PPE, tools, and clothing. Additionally, employees used the stairwell as a changing area; therefore, the passageway was not kept clear of other employees as they changed into and out of street clothes.

29 CFR  1926.416(e)(1): Worn or frayed electric cords or cables shall not be used.  On August 27, 2025, at a worksite located at 183 Main Street in Fond du Lac, Wisconsin; the flexible exterior sheathing for the electrical extension cord, which was used to power air scrubbers (negative pressure air machines) was frayed which exposed the insulated conductor cables within.
