29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  On or about September 18, 2025, the employer did not implement a continuing, effective hearing conservation program which includes noise monitoring, employee notification, audiometric testing, training, information, and recordkeeping for employees exposed to noise equal to or exceeding a dose of fifty percent. Noise dosimetry showed an employee working on Little Eberly as a stacker/ capper was exposed to noise at 78% of the permissible daily dose as measured over 564 minutes of sampling. This dose is equivalent to an exposure of 87 dBA which exceeds the adjusted action level of 83.8 dBA.
