29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part. Wellman Brothers, Inc. at the worksite located at 225 Main St. in Celina, OH: On or about September 10, 2025, the employer did not implement a plan or program to identify job site hazards for employees to maintain a safe working environment. Such a program would allow the employer to identify potential fall hazards during job site operations, decreasing the probability of employee injury. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. Wellman Brothers, Inc. at the worksite located at 225 Main St. in Celina, OH: On or about September 10, 2025, the employer did not ensure that a personal fall arrest system was used by employees operating the JLG aerial lift (model 860SG; s/n 0300212323) to perform brick restoration work at heights of approximately 10 feet and up to 25 feet. No additional abatement information is needed for this item.

Wellman Brothers, Inc. at the worksite located at 225 Main St. in Celina, OH: On or about September 10, 2025, employees performing brick restoration from a flat roof were exposed to a nine-foot fall hazard. The employer did not ensure that unprotected sides were guarded to prevent falls. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
