29 CFR 1926.300(b)(1): Power operated tools when designed to accommodate guards, were not equipped with such guards when in use: a) Wellman Brothers, Inc. on or about August 02, 2011, at the address of 312 N. Broad St. Kalida, OH: The employer did not ensure a Bosch angle grinder was equipped with the appropriate factory provided guard while in use. Employees were using the unguarded tool to grind masonry joints. The employees were exposed to potential contact of the blade during grinding operations.

29 CFR 1926.451(c)(2)(i): Footings were not level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement.\r\n\r\na) Wellman Brothers, Inc. on or about August 02, 2011, at the address of 312 N. Broad St. Kalida, OH: The employer failed to assure footings in which base plates and mud sills were placed were capable of supporting the scaffolding load. Mud sills (2x8 boards) supporting the load had begun to fracture due to the softer soil (footing) below. Employees working from this condition were exposed to a fall up to 130ft to the ground below.

Broad St. Kalida, OH: The employer failed to assure the 130ft tall scaffolding system used during masonry activities was designed by a registered professional engineer. Engineered plans would accurately identify erection specifications and limitations of use.
