29 CFR 1910.38(c)(5):The employer did not have the minimum element of an emergency action plan that addressed procedures to be followed by employees performing rescue or medical duties: a) 1735 Monad Rd, Billings MT.: On or about September 10, 2025, and at times prior, employees were exposed to chemical and smoke inhalation hazards from an adjacent incinerator that was being utilized in the same building. The employer failed to implement steps to be followed for the rescue of animals in the event of an emergency leading to employees re entering the smoke filled facility to perform rescue operations.
