29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: At the site located at 1800 Morris Street, Fond du Lac, Wisconsin, the employer failed to create a hazardous energy control procedure for the Atech Manual Miter Saws (Skat - 06P- 16 inch). The saws had multiple energy sources (electrical and kinetic wind down), and the employer did not create a procedure for employees to follow during servicing and maintenance work to control all of the energies.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about July 24, 2025, at the site located at 1800 Morris Street, Fond du Lac, Wisconsin the employer failed to ensure that employees operated the Atech Skat 16 inch manual miter saw with the guard in operating condition. While cutting lumber that was approximately 5-3/8" by 4-1/2" in half at an angle, an employee was holding the guard up which resulted in their left pointer finger making contact with the rotating blade.

29 CFR 1910.242(a):Hand and portable powered tools or equipment were not kept in safe condition: On or about September 22, 2025, in the Motor Mounts Department, the employer failed to maintain an Everwin Pnuematic Coil Nailer in a safe condition, in that an employee was instructed to pull back on the safety device on the muzzle of the nailer allowing the tool to shoot nails with only the single action of the trigger which resulted in the employee shooting a nail into the palm of their left hand resulting in an injury that required on job transfer or restriction.
