OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, specifically exposing employees to struck-by hazards from vehicular traffic.  A) TA Operating, Inc. On October 23, 2025, at mile marker 14 on I 80 West, an employee was walking near the active lane side of the shoulder to speak with the driver of a disabled tractor trailer before performing roadside maintenance at dawn. This placed the employee in a struck by hazard zone with oncoming traffic traveling at the posted speed limit of 55 to 65 miles per hour. The employee was fatally struck by an approaching box truck.  Incident occurred on October 23, 2025
