29 CFR 1926.501(b)(13 ):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  Nova's Painting and Remodeling LLC does not ensure that each employee is using appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about November 3, 2025, at 310 South Euclid Ave Westfield, NJ:  Instance A-Back Side of Roof) Employee #1 who was engaged in roofing activities on the two-story residential home when he fell to his death. The employee was exposed to a fall of approximately 18'11'' to the ground below as a personal fall arrest system, guardrail system, or safety net were not being used. The employee was wearing a harness as part of a personal fall arrest system; however, he was not tied off.  Instance B-Back Side of Roof) Employee #1 who was engaged in roofing activities on the two-story residential home was using a harness that was designed for rock climbing and tree climbing and not a full-body harness for fall protection per Subpart M. The harness being used has a harness weight limit: 300KG. With a breaking strength of 15KN, which equals 3,372 pounds. The alloy buckets have a rated capacity of 18KN, which is equivalent to 4,000 pounds. The harness should have had Dee-rings and snap hooks with minimum tensile strength of 5,000 pounds (22.2 KN).  Instance C-Back Side of Roof) Employee #1 who was engaged in roofing activities on the two-story residential home was using a hand ascender rope grab/clamp that was designed for rock climbing and tree climbing. The rope grab/clamp being used has a weight limit of 4KN and a breaking strength of 4 KN, which equals 899lbs. Connecting assemblies shall have a minimum tensile strength of 5,000 pounds (22.2 KN)  Instance D-Back Side of Roof) Employee #1 who was engaged in roofing activities on the two-story residential home was using a ridge anchor that only had a total of four screws and or bolts securing it. User instruction manual for this type of roof anchor indicates the user to install 12d nails only and to use 10 nails per leg in order to obtain the 5,000lbs anchorage strength. 29 CFR  1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.   A)310 South Euclid Ave Westfield, NJ   Aluminum extension ladder which was being used to access the upper roof did not extend at least three feet above the upper landing surface of the roof. This condition exposed employees to fall hazards.   Hazard noted on or about 11/3/2025
