29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were the employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) On or about November 19, 2025, at the above-mentioned address, the employees were exposed to fall hazards of approximately 12 feet ground to eave while performing residential roofing work.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   a) On or about November 19, 2025, at the above-mentioned address, an extension ladder used by employees to gain access to the working surface did not have its side rails extended 3 feet above the upper landing being accessed.  Humberto Garcia dba Humberto Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1) which was contained in OSHA inspection number 1749510, citation 2, item 2, and was affirmed final order on September 9, 2024, with respect to a workplace located at 1570 Britanny Lane, Hoffman Estates, IL 60192.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
