29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)Werk Weld, Inc. at 28143 U.S. Highway 281, Armour, SD 57313:  On or about and at times prior to January 7, 2026,  the employer did not ensure the RAS GIGAbend 76.30 Rlinhardt Maschinlnbau, Model Number: 76.30 was properly guarded.   This condition exposed employees to caught-in and amputation hazards.  (b)Werk Weld, Inc. at 28143 U.S. Highway 281, Armour, SD 57313:  On or about and at times prior to January 7, 2026, the employer did not ensure the Ellis Manual Drill Press, Model Number: 9400, Serial Number: 94D04284 was equipped with a properly installed guard over the drill chuck of the machine. This condition exposed employees to caught-in and amputation hazards associated with the exposed area of unguarded mechanical action.

29 CFR  1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:  (a)Werk Weld, Inc. at 28143 U.S. Highway 281, Armour, SD 57313:  On or about and at times prior to January 7, 2026, the employer did not ensure that the Cincinnati Metal Shear, Model Number: 1812, Serial Number: 32433 front guard was properly adjusted to protect from operator contact with the shear blade while the machine was in use.  This condition exposed employees to caught-in and amputation hazards associated with the exposed area of unguarded mechanical action.  (b)Werk Weld, Inc. at 28143 U.S. Highway 281, Armour, SD 57313:  On or about and at times prior to January 7, 2026, the employer did not ensure that the Uni-Hydro, Inc. Iron Worker, Model Number: P80-24, Serial Number: 3P801504X front guard was  properly adjusted to protect from operator contact with the shear blade while the machine was in use.  This condition exposed employees to caught-in and amputation hazards associated with the exposed area of unguarded mechanical action.  (c)Werk Weld, Inc. at 28143 U.S. Highway 281, Armour, SD 57313:  On or about and at times prior to January 7, 2026, the employer did not ensure that the Uni-Hydro, Inc. Iron Worker, Model Number: P50-14, Serial Number: 1B5065X front and rear guards were properly adjusted to protect from operator contact with the shear blade and center bending station while the machine was in use.  This condition exposed employees to caught-in and amputation hazards associated with the exposed area of unguarded mechanical action.
