29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  (a) On or about January 8, 2026, at N106 W6540 Stone Lake Circle, Cedarburg, WI 53012, employees conducting framing operations were not protected from falling through holes on the first floor into the basement.

29 CFR  1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval.  (a) On or about January 8, 2026, at N106 W6540 Stone Lake Circle, Cedarburg, WI 53012, an employee used a JLG Skytrak, model number 10054 rough terrain forklift to lift an exterior wall by the means of placing slings onto the tines of the forklift for a below-the-tines lift (free rigging), thereby exposing the employees to a struck-by and/or caught-between hazard if a loss of load would occur or the forklift tipped.

(a) On or about January 8, 2026, at N106 W6540 Stone Lake Circle, Cedarburg, WI 53012, the employer did not ensure employees operating the JLG Skytrak, model number 10054 rough terrain forklift were trained, evaluated and certified in the safe operation of the all-terrain forklift.
